The Work Time and Logbooks Rule, as approved, incorrectly provides an exemption for "light" vehicles (under 3,500 kg) used to carry goods for hire or reward. These vehicles are already exempted by the coverage provision for logbooks, stated in section 30ZE(1)(c) of the Land Transport Act 1998. Land Transport NZ is expecting to propose some amendments to the rule later in 2008, but in the interim the anomaly of medium goods vehicles being subject to logbook requirements for local deliveries, while many trucks over 6,000 kg are not, needs to be addressed.
This exemption applies to vehicles that have a GLW of 3,500 kg - 6,000 kg; heavier vehicles needing a class 2 licence are already exempted by the rule when operated within a 50 km radius.
The exemption is consistent with the application of section 166(2)(c) of the Land Transport Act 1998, which allows exemptions on the grounds that the "the prescribed requirements are clearly unreasonable or inappropriate in the particular case".
Please note: an exemption from logbooks is not an exemption from work time limits.
Pursuant to section 30ZA(1)(b) of the Land Transport Act 1998, and pursuant to an authority delegated to me by the Director of Land Transport, I, Jennifer Gail McIlroy, Manager Operational Development and Monitoring, hereby exempt drivers of the vehicles specified below from the requirement to maintain a logbook.
This exemption applies to drivers of heavy motor vehicles that require a class 1 or 2 driver licence and are used to carry goods for hire or reward when the vehicle is:
