Why consult?

Rules

The Minister of Transport has a statutory responsibility under the Land Transport Act 1998 when making a rule to notify the intention to make the rule and to consult with interested groups on the proposed rule. In practice, Land Transport New Zealand undertakes consultation on behalf of the Minister.

Land Transport NZ is committed to ensuring that the rule-making process is transparent, that rules are sound and robust and that the consultation process takes account of the views of, and the impact on, industry and other groups and individuals affected by a proposed rule. Accordingly, Land Transport NZ goes beyond the minimum statutory requirements by maintaining a database of interested groups and individuals and undertaking extensive consultation on each rule, with affected industry and other groups and individuals, government departments and agencies and the public. Submissions received on draft rules are summarised and analysed and the rule redrafted to take into account the submissions received. If necessary, further consultation with key groups is undertaken before a proposed rule is submitted to government.

Policy consultation and communication

Land Transport NZ consults and communicates with relevant organisations and individuals whenever substantive policy development, enhancement or review is undertaken. The details of this consultation and communication process are outlined in Appendix A of Land Transport NZ’s Programme and funding manual.

Current consultations

• Draft New Zealand national minimum standard for urban buses aims to enhance the attractiveness of urban public transport vehicles in order to encourage increased usage, with a particular emphasis on improving accessibility. Submissions close on 3 October 2008.
• Draft Land Transport Rule: Omnibus Amendment 2008 contains proposals to change requirements in a number of existing Land Transport Rules. Submissions close on 16 September 2008.
• Draft Land Transport Rule: Vehicle Equipment (Noise) Amendment [2009] proposes changes to the noise testing requirements for vehicles. The Rule is aimed particularly at vehicles with modified exhausts that are not complying with the current noise requirements. Submissions close on 17 September 2008.
• Draft Land Transport Rule: Steering Systems Amendment [2009] proposes to revise the requirements applying to the certification and use on New Zealand roads of left-hand drive vehicles and to ensure that the process is effective, is not open to abuse, and is free of unnecessary requirements and anomalies. Submissions close on 21 August 2008.
